Android Question No Menu Button

I recently ran into a device that has no menu button. The device says it has been replaced with most recent or something like that. Anyway, my question is how do I detect this no menu button and how do I three dot menu?

Many devices do not have a menu button. The three dots will appear automatically if you add at least one menu item.
